General Terms and Conditions (GTC)

1. Provider and Scope
These General Terms and Conditions (GTC) apply to orders placed via the online shop nutrexin.ch as well as, where applicable, to orders placed by telephone or via other individual means with Nutrexin AG.

The GTC apply to both private customers (B2C) and business customers (B2B), in particular specialist retailers, therapists, and other commercial purchasers.
Individual terms and conditions may be agreed upon for business customers. Such individual agreements, particularly regarding prices, discounts, minimum quantities, payment terms, or delivery conditions, shall take precedence over these GTC.
2. Offer and Products
The range of products available in the online shop at the time of order is decisive. Illustrations, product images, and other representations are for illustrative purposes only. Minor deviations in representation, packaging, or presentation are reserved, provided they do not alter the essential characteristics of the product.
The product information in the online shop is created with the greatest possible care. The details on the respective product packaging are authoritative.
The availability of the products offered remains subject to change. Should a ordered product not be available after completion of the order, the customer will be informed. Payments already made for products that cannot be delivered will be refunded.
3. Order and Conclusion of Contract
Before finalizing an online order, the entered data and the selected products can be reviewed and corrected. By submitting the order, the customer places a binding order.
Receipt of the order is confirmed electronically. Nutrexin AG reserves the right to reject or cancel orders, particularly in cases of obvious pricing or product errors, lack of availability, or reasonable suspicion of abuse.
For orders placed by telephone or via other individual means, the contract is concluded in accordance with the respective agreement between Nutrexin AG and the customer.
4. Prices, Discounts, and Shipping Costs
The prices in Swiss Francs (CHF) stated in the online shop at the time of the order apply. Prices include the legally applicable value-added tax, if applicable.
Deliveries within Switzerland and to Liechtenstein are free of shipping costs.
Promotional prices, discount codes, and other benefits are subject to the terms communicated at the time. Unless expressly stated otherwise, discount codes cannot be combined and cannot be applied retroactively to already completed orders.
For product bundles, the prices and conditions stated in the online shop for the respective offer apply.
5. Payment Terms
The payment methods available in the online shop are displayed during the order process. Payment processing may be handled by external payment service providers.
For orders placed by telephone, delivery against invoice may be arranged upon agreement. Unless otherwise agreed, the payment deadline is 30 days from the invoice date.
In the event of late payment, statutory provisions apply.
6. Delivery, Delivery Area, and Delivery Time
Deliveries are made exclusively within Switzerland and to Liechtenstein.
The usual delivery time is 2–3 working days. The stated delivery time does not constitute a guaranteed delivery date, unless expressly agreed otherwise.
Delivery is made to the delivery address provided by the customer. The customer is responsible for the accuracy and completeness of the address information.
If the customer has made special delivery arrangements with the respective transport service provider, such as a drop-off authorization, delivery may be made in accordance with these agreements.
7. No Voluntary Right of Withdrawal, Return, or Exchange
Nutrexin AG does not grant any voluntary right of withdrawal, return, or exchange.
Duly delivered and defect-free products cannot, therefore, be returned or exchanged. This applies in particular to food and dietary supplements.
Statutory claims regarding defective or incorrectly delivered products, as well as claims in connection with product recalls or mandatory legal provisions, remain reserved.
8. Inspection of Delivery, Incorrect Deliveries, and Defects
The customer is requested to check the delivery upon receipt for completeness, obvious transport damage, incorrect deliveries, and recognizable defects, and to notify Nutrexin AG of any complaints as soon as possible.
In the event of a proven incorrect delivery or a justified defect, Nutrexin AG will generally provide a replacement, provided this is possible and legally permissible.
If a replacement delivery is not possible or not reasonable, further claims shall be determined according to the applicable statutory provisions.
9. Warranty
The statutory warranty provisions apply to defects, unless otherwise validly regulated in these GTC.
In the case of justified defects, Nutrexin AG is generally entitled to provide a replacement first, provided this is possible and reasonable for the customer. Mandatory statutory claims remain reserved.
Excluded from the warranty are damages or impairments caused, in particular, by improper storage, improper use, or failure to observe product and application instructions after delivery of the product.
10. Food and Product Safety / Product Recalls
The statutory provisions regarding food and product safety remain fully reserved.
Should a product recall or safety-related information be required for a product, Nutrexin AG may inform affected customers using the contact details provided during the order process, provided this is necessary and permissible.
Instructions in connection with product recalls or safety information must be followed.
11. Notes on Dietary Supplements
Dietary supplements are not a substitute for a varied and balanced diet or a healthy lifestyle.
The consumption recommendations, warnings, and storage instructions on the product packaging must be observed. The specified recommended daily intake must not be exceeded.
In the case of special personal circumstances or uncertainties regarding the use of a product, the respective product information should be observed, and a qualified professional consulted if necessary.
12. Retention of Title
The delivered goods remain the property of Nutrexin AG until full payment has been received, to the extent permitted by law.
13. Liability
Nutrexin AG is liable in accordance with applicable statutory provisions.
To the extent permitted by law, liability for damages resulting from improper use or storage of the products, failure to follow product or application instructions, or circumstances beyond the influence of Nutrexin AG is excluded.
Liability for intent and gross negligence, as well as for cases of liability that may not be excluded or limited under mandatory law, remains reserved.
14. Data Protection
Personal data is processed in accordance with applicable data protection regulations. Further information on the processing of personal data can be found in the privacy policy on nutrexin.ch.
15. Copyright and Intellectual Property
The contents of the online shop, in particular texts, images, graphics, logos, and other design elements, are protected by copyright and/or trademark law. Use beyond that which is legally permitted requires the consent of the respective rights holder.
16. Force Majeure
To the extent permitted by law, Nutrexin AG is not liable for delays or non-performance of contractual obligations caused by events beyond its reasonable control.
17. Amendments to the GTC
Nutrexin AG may amend these GTC with effect for future orders. The version applicable at the time of order completion is generally decisive for an order.
18. Severability Clause
Should any provision of these GTC be invalid or unenforceable, in whole or in part, the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by the applicable statutory provisions.
19. Applicable Law and Place of Jurisdiction
Swiss law applies, excluding the UN Sales Convention (CISG), provided its exclusion is permissible.
For consumers, the legally provided places of jurisdiction apply.
For business customers, the place of jurisdiction is Zurich, to the extent permitted by law.
